Terms of Use

Welcome to OS. These Terms of Use (“Terms”) form a binding agreement between you and OS governing your access to and use of the OS application, website, and related services (the “Service”). By creating an account or using the Service you confirm that you are at least 18 years old and that you accept these Terms. If you do not agree, do not use the Service.
1. What OS is
OS is non-custodial wallet software. It provides an application and interface that let you hold, send, receive, request and swap digital assets such as USDC on supported networks. OS is not a bank, broker, exchange, money services business, or money transmitter; it does not take deposits, hold client money, lend, or pay interest. Regulated services offered through the app — such as buying or selling crypto with fiat, or the virtual card — are provided by licensed third-party partners under their own terms and licences. OS acts only as a technology interface and earns a commission from those partner arrangements.
2. Self-custody and your responsibility
Your wallet is yours and only you control it. OS never takes custody of your assets and cannot move, freeze, reverse, recover, or restore them. You are solely responsible for safeguarding your sign-in method, recovery, device, and any exported private key, and for verifying every transaction before you authorise it. Losses arising from your own error, negligence, or compromised credentials — including a lost, shared, or exported private key, sending to the wrong address or network, or falling victim to a scam — are your responsibility, and OS cannot reimburse or reverse them.
3. Eligibility and compliance
You must be at least 18 years old and have full legal capacity to accept these Terms. You may not use the Service if you are located in, or a resident of, a country subject to comprehensive sanctions, or if you appear on any sanctions or prohibited-persons list. You are responsible for complying with all laws that apply to you, including tax, reporting, and currency-control rules in your jurisdiction.
4. Your account, peertag and profile
You access OS with an email sign-in, and embedded wallets are created for you and remain under your control. Your peertag is a unique handle that links to your OS wallet to make receiving easier. The peertag system works only within the OS platform and OS wallets, and only on the Solana network; it is not a universal address and cannot be used to receive funds outside OS. You must not choose a peertag that impersonates another person or brand, and we may reclaim peertags that are inactive or that breach these Terms. You may also connect external wallets you own — such as Phantom, Solflare, Backpack, or MetaMask — to your account from within the app. Connecting is for linking only: it is never a way to sign in or create an account, and it does not give OS custody, control, or access to the keys of those wallets, which remain solely yours and keep signing within their own apps. You are responsible for any wallet you choose to link and for every transaction you authorise with it, and you can disconnect a linked wallet at any time without affecting the wallet or its contents.
5. Contacts and discoverability
OS lets you save contacts, import contacts from your device (with your permission), and find other users who have chosen to be discoverable by phone number, email, or peertag. Discoverability is off unless you turn it on, and you can switch it off at any time, after which others can no longer find you that way. You are responsible for having the right to add any contact information you import and for using other people’s details lawfully.
6. Payments, notes and requests
When you send, you may add a short note (“what for”) that is stored with your activity and statements; do not include sensitive personal data in notes. You can create payment requests that generate a shareable link or QR code pre-filling the amount, your peertag, and any note. A request is an invitation to pay, not a guarantee of payment; the payer decides whether and when to pay.
7. Transactions are final
Blockchain transactions are irreversible. Once a transfer is submitted to a network it cannot be undone, cancelled, charged back, or refunded by OS. Always check the recipient, amount, and network before you send. Network fees are paid from your wallet, except where OS expressly sponsors them under a paid plan (see OS Pro).
8. Third-party partners and licensing
The Service integrates licensed and specialist partners, including embedded-wallet infrastructure, on/off-ramp providers for buying and selling crypto with fiat, card issuing and processing partners for the virtual card, and decentralised swap providers. Those services are provided under the partners’ own terms and regulatory licences, and you may be asked to accept their terms or complete identity checks (KYC/AML) directly with them. OS is not a party to your transactions with these partners and earns only a commission from partner arrangements; the partners, not OS, are responsible for the licensed services they provide. For example, when you add money, the purchase of crypto with your card or bank transfer is carried out by our on-ramp partner (such as Stripe), not by OS. Such purchases may be unavailable in some countries or regions, usually require identity verification (KYC), and are governed by that partner’s own privacy policy and terms of use, under which they — not OS — collect and handle your payment and identity data. Any fees the partner charges are shown to you before you confirm the purchase, and any payment problem, refund, chargeback, or dispute must be raised directly with that partner. OS only provides the interface to start the purchase and load your own wallet; we are not the seller, we never take custody of your money, and we accept no liability for purchases made through Stripe or any other partner. 9. The virtual card
The virtual Visa card is a OS Pro benefit issued and processed by our licensed card partner under their terms. It works only where Visa is accepted and within the limits and controls shown in the app. Because the card depends on an active OS Pro subscription, it is deactivated immediately and automatically if your subscription is cancelled, lapses, or is suspended. OS and its card partner may decline, limit, freeze, or reverse card transactions to comply with law, scheme rules, or risk controls.
10. Cancellation and refunds
You can cancel OS Pro at any time from the app. On cancellation your virtual card is deactivated instantly and Pro benefits end. Unless required by law, payments already made are non-refundable; where a statutory cooling-off or consumer right applies, you may request a refund within the period your local law allows. Monthly plans renew until cancelled, and cancelling stops future charges. We may suspend or terminate a plan for non-payment or breach of these Terms.
11. Acceptable use
You agree not to use the Service for unlawful activity, fraud, money laundering, terrorist financing, sanctions evasion, or to infringe others’ rights, and not to interfere with, attack, reverse-engineer, or gain unauthorised access to the Service or to other users’ wallets.
12. No financial advice
Nothing in the Service is financial, investment, legal, or tax advice. Digital assets can be volatile and may lose value; you use them at your own risk.
13. Availability
The Service is provided “as is” and “as available”. We do not guarantee it will be uninterrupted, error-free, or available at any particular time, and we may update, suspend, or discontinue features, perform maintenance, or depend on third-party networks and partners whose availability we do not control. Because OS is non-custodial, you can export your wallet and access your funds independently at any time.
14. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service is provided without warranties of any kind, and OS (including its officers, employees, and partners) is not liable for any indirect, incidental, special, or consequential loss, or for any loss of funds resulting from: your own acts or omissions; lost, shared, or exported credentials or keys; transactions you authorise; errors in a recipient, amount, or network; the acts, omissions, or availability of third-party partners or blockchain networks; or events outside our reasonable control. Where liability cannot be excluded, it is limited to the amount you paid OS for the Service in the 12 months before the claim. Nothing in these Terms excludes liability that cannot be excluded by law, including your non-waivable consumer rights.
15. Indemnity
You agree to indemnify and hold OS harmless from claims, losses, and costs arising from your misuse of the Service, your breach of these Terms, or your violation of any law or third-party right.
16. Force majeure
OS is not responsible for any failure or delay caused by events beyond our reasonable control, including blockchain or network congestion or failure, outages of partners or infrastructure providers, cyber-attacks, acts of government, sanctions, pandemics, natural disasters, or other force-majeure events.
17. Governing law and your local rights
These Terms are governed by the laws of England and Wales, without affecting the mandatory consumer-protection rights you have under the laws of your country of residence — including, where applicable, the United Kingdom, the European Union/EEA, the United States and California, and jurisdictions across Asia and the rest of the world. Where local law gives you stronger rights, those rights prevail, and disputes are handled by the courts with jurisdiction under your local law.
18. Changes and termination
We may update these Terms and will notify you of material changes in the app; continuing to use the Service means you accept the updated Terms. You may stop using the Service at any time, and we may suspend or end access for breach, legal reasons, or discontinuation of the Service — in which case you keep independent access to your wallet.
19. Swaps (decentralised exchange)
The swap feature lets you exchange digital assets from your own wallet through decentralised liquidity routed by Jupiter (on Solana) or the other routing providers shown in the app. OS provides the interface only: it is not a party to any swap, does not act as counterparty, broker or exchange, and never holds your assets. Quoted prices, fees and slippage are indicative estimates; final execution happens on-chain and can differ, especially in fast or thin markets. Tokens shown or searchable in the app come from third-party token lists and are not vetted, endorsed or recommended by OS — you are solely responsible for researching any token before trading, and tokens can lose all value. Swaps are irreversible once confirmed. To the maximum extent permitted by law, OS accepts no liability for any loss arising from a swap, its routing, its pricing or the tokens involved.
20. Pearl (AI assistant)
Pearl is an optional in-app AI assistant that can explain your account and how OS works. Its answers are generated automatically, may be incomplete or inaccurate, and are provided for information only — they are never financial, investment, legal or tax advice and never a recommendation to buy, sell, hold or time any asset. Your Activity screen and the blockchain, not Pearl's answers, are the authoritative record of your account. You must not rely on Pearl for any decision, and to the maximum extent permitted by law OS accepts no liability for actions taken based on its output.
21. Risk disclosures
The in-app Disclaimers page forms part of these Terms and contains the full risk disclosures for the Swap, Earn and Stocks features — including that digital assets, tokenized stocks and yield products are volatile and that you can lose 100% of what you commit. By using those features you confirm that you have read and accepted the Disclaimers page and any feature-specific acknowledgements shown in the app.
